To become a member and start borrowing equipment from Community Toolbox Canberra, you need to read, understand and agree to the following:

These are available in the application form and in your online account once you become a member. We also provide them here for prospective members.
If we change anything, members will need to re-sign the agreements before they can borrow items.
Borrowing terms & conditions
These rules help keep the Toolbox running smoothly and help keep both you and the Toolbox safe. You will need to agree to these when applying for membership and abide by them when borrowing equipment.

Membership
1. To borrow from the Toolbox, you’ll need to be a financial or associate member.
2. Becoming a member: To become a member of the Toolbox and start borrowing equipment, you’ll need to:
1. Register your details with us. We’ll verify your identity and address with your photo ID when you visit the Toolbox for the first time.
2. Read and agree to these ‘Borrowing Terms and Conditions’
3. Read and agree to the ‘Deed of Release from Liability’
4. Pay your membership fee.
3. Age 18+ years: You need to be at least 18 years old to become a member of the Toolbox.
4. Household membership: If you share your house with other adults, you can nominate one of them to be an associate member for the duration of your membership, without extra charge. You can change your nominated associate member once every twelve months.
5. Renewing membership: Toolbox membership is annual, with renewals falling due on your anniversary. You will be sent reminders to renew your membership or that your auto-renewal is approaching.
6. Refusal to lend: The Toolbox can refuse to lend to members for any reason.
7. Rejection of membership: The Toolbox can refuse a new membership or to renew an existing membership for any reason.
8. Membership of SEE Change: Membership of the Toolbox includes membership of our auspice organisation, SEE Change https://seechange.org.au/
Borrowing and returning equipment
1. Item limit: You can borrow up to fifteen (15) items at a time.
2. Borrowing hours: You can borrow items during Toolbox opening hours www.communitytoolboxcbr.org.
3. Loan period and returns time: Loans are for two (2) weeks. Popular items have a one (1) week loan period. Please return items early in the shift on the due date, to allow time for other members to borrow them.
4. Reserving items: You can reserve items through MyTurn, the catalogue system. You will be notified by email when the item is ready for pickup. Please cancel your reservation if you no longer need it. If you don’t pick up the item on the day, we will cancel your reservation.
5. No out-of-hours returns: We cannot accept returns outside of our opening hours. You agree 6to not leave items when the Toolbox is not open.
6. Loan extensions: You can extend your loan twice through MyTurn. If you have already extended twice, the item has been reserved by another member, or it is an electrical item due for testing, this option will not be available. Please do not ask to extend an item that you have not been able to extend online.
7. Overdue items: We send overdue notices. We reserve the right to charge late fees at a rate of $1.00 per day and to suspend your membership pending payment.
8. Clean items before return: You agree to return items clean and ready for the next member. We reserve the right to charge a cleaning fine (from $5/item) or, for extreme or repeated cases, suspend your membership.
9. Repair costs: If an item is damaged through mis-use, you agree to cover the cost of repair or replacement.
10. Non-return of item: If you don’t return an item, you agree to pay the cost of replacement.
11. Non-payment: The Toolbox tries to accommodate financial hardship. We reserve the right to suspend your membership if fees remain unpaid and there has been inadequate communication.
Use of equipment
1. Member use only: Only you and your nominated secondary member are allowed to use the Toolbox’s equipment.
2. Stop using and report unsafe/broken items: You agree to immediately stop using any item that is unsafe or damaged and to report the issue to the Toolbox. You agree to not attempt to repair or modify with any Toolbox items.
3. Use items properly: You agree:
1. to refer to, and follow, the use and safety instructions
2. to determine that an item is suitable for your purpose
3. to operate the item with an adequate power source (if applicable)
4. to do a thorough hazard and risk assessment before using the item
5. to return the item in a clean state and in good repair.
Transport
1. Transporting items: You will need to come prepared to transport borrowed items from and to the Toolbox yourself. We do not provide a delivery/pickup service.
2. Safe loading, handling and securing: While we will assist and advise where we can, it’s up to you to ensure the safe loading, handling and securing of all items in your vehicle in accordance with all laws and manufacturer’s guidelines.
Deed of Release from Liability
Deed agreement:
1. I acknowledge that I am over 18 years of age, I am capable and experienced in using the equipment I am borrowing from Community Toolbox Canberra (Toolbox), and that I will use the equipment I am borrowing in a safe and proper manner.
2. I acknowledge and agree that use of equipment borrowed by me may be dangerous and could result in accidents, injury, loss or damage of various kinds. I acknowledge and agree that my use of any Toolbox equipment is at my own risk. I hereby assume, to the extent permitted by law, all risks of loss, damage or injury (including death) which may be sustained by me, or other people, which is in any way connected with my use or loan of any Toolbox equipment.
Toolbox equipment can be dangerous. I am responsible for any bad things that happen to me when I borrow or use Toolbox equipment.
3. I acknowledge that the Toolbox and its officers, committee members, employees, agents, contractors, successors and assignees , including those from the auspicing organisation SEE-Change (“Toolbox Representatives”), will not be liable for, and release these persons from, any present or future claim, loss, liability, damage, cost or expense (whether arising under statute, from negligence, personal injury, death, property damage or infringement of third party rights or otherwise) that arises as a result of any act, matter or thing done, permitted or omitted to be done which is in any way connected with my use or loan of any Toolbox tools. I acknowledge and agree that, to the extent that any warranty regarding any tool I am borrowing is implied by operation of law, it is excluded to the full extent permitted by law.
The Toolbox and its workers are not responsible for any bad things that happen to me when I borrow or use Toolbox equipment. There are some warranties, such as under consumer law, that can’t be excluded in this document.
4. I agree to indemnify and keep indemnified the Toolbox and the Toolbox Representatives against any present or future claim, loss, liability, damage, cost or expense which may be incurred by the Toolbox or any or all of the Toolbox Representatives as a result of any act, matter or thing done, permitted or omitted to be done by me or which is in any way connected with my use or possession of any Toolbox equipment.
The Toolbox and its workers are not responsible for any bad things I do with Toolbox equipment.
5. I acknowledge and agree that a term (or part or parts thereof) of this release and indemnity will not apply where the term contravenes the law of the relevant jurisdiction under which any legal action is legitimately taken, however, such terms (or part or parts thereof) are severable and do not invalidate the remaining terms.
If the Toolbox or its workers do have liability that cannot be excluded in this document, then they will be responsible for that. But the rest of this deed still counts.
6. I acknowledge and agree that the above information is current, true and correct; that I have also read and fully understand and agree to the Borrowing Terms and Conditions of the Toolbox; and I understand that failure to comply with any of these rules may result in revocation of my borrowing rights.
